Terms of Service

➤ Effective as of December 31st, 2025.Throughout these terms, all second-person references (i.e. “you”) and third-person references (i.e. “they”) refers to the client, who requests the commission service and all first-person references (i.e. “me”) refers to the artist, who provides these commission services.Submission of a request form is considered confirmation that you have read, understood, and agreed with the Terms of Service. Claims in the absence of awareness and/or exploitation of loopholes are not a permitted reason for violation of any section of these terms. The Terms of Service is not exhaustive–details not included do not grant allowance by default. If you do not read, understand, or agree with the terms, these services will not be provided to you.I reserve the right to update these terms without prior notice. You are responsible for keeping yourself up to date with any changes.Before submitting a request form, please be aware of the processing fees that are taken from your payment. These fees cannot be refunded and are excluded from instances of “full” and “100%” refunds.

ㅤI. CURRENCY & PAYMENTSㅤ1. All commission service prices are in the United States Dollar (USD).2. Services priced at $100 USD or higher are eligible to be paid in 50/50 installments. The first payment must be made upfront while the second payment must be made before the final phase begins.3. The accepted payment methods are as follows:⚪ Cashapp
⚪ Ko-fi
⚪ PayPal Invoice
⚪ VGenRequests for unlisted payment methods are not permitted; if any of these payment methods are unavailable to the client or not of the client's preference, these services will not be provided.

ㅤII. SERVICE REQUESTSㅤ1. By submitting a request, you agree to be 18 years old or older.2. Submitting a request form does not guarantee approval.3. Request forms submitted and paid on someone's behalf are prohibited with exceptions. These exceptions are limited to the following:⚪ The client is a parent or legal guardian to someone under 18 years of age.
⚪ The client plans to deliver the commission(s) as a gift without the recipient’s knowledge.➤ The client MUST provide proof of the recipient’s consent to artwork made of their persona or original creation(s) via direct quote by linking to a post or profile. Screenshots as proof are not accepted.4. You are responsible for reading the request form thoroughly and providing as much detail as possible to ensure you receive what you wish with minimal to no need for revision.5. All visual references submitted must be created by you or another creator with proof of their permission for use in your request form. Visual references created from Generative Artificial Intelligence (GenAI) are not accepted and will result in automatic denial of your request.

ㅤIII. COMMUNICATION & PRODUCTIONㅤ1. Commissions will be produced in my own art style. Requests for style replication are currently not accepted.2. Clients submitting a request form and receiving the final commission(s) must be the same person in direct communication throughout the full duration of production.3. All communication will be written; communication via video or voice is not permitted. Communication is accepted via the following contact methods:⚪ On-site direct messages
⚪ My Discord server (ask for single-use invite)
⚪ Email4. Once the client has been notified for approval of their request, production will begin after the client’s acknowledgement of said approval. Turnaround time approximates will be available in service details with more accurate details provided in proposals per client. Predisposed deadlines are currently not accepted—requests containing such will be automatically declined.5. Throughout production, there will be three (3) phases. These phases are the sketch phase, the lines phase, and the colors phase.6. Clients are allowed to request updates as often as they wish within reason, however a response may take up to three (3) days upon the request. General updates will occur once progress is made and may differ per client.7. Clients will be notified as soon as possible of any sudden production delays or if the commission(s) cannot be completed before the due date.8. Clients are responsible for requesting a due date extension if aware they will not be available by the time the initial due date arrives. In case of sudden absence without warning, clients will be given seven (7) days to confirm finalization. Failure to do so within these seven (7) days will result in the commission(s) to be considered final and marked complete.9. Clients with a VGen account will receive their final delivery via VGen’s direct messages. Clients without a VGen account will receive their final delivery via the email provided in their request form regardless of chosen communication method unless absolutely necessary.10. Any and all forms of harassment conducted by the client throughout production will result in immediate cancellation without refund. The client will thus be blacklisted with a notice issued to other artists.

ㅤIV. PRODUCTION FEESㅤ1. Requesting commissions for commercial use ordered under the pretense of personal use to evade the appropriate fees is prohibited and grounds for blacklisting.2. Privacy request fees, including Non-disclosure Agreements (NDA), start with a minimum of 15% of the base price and may increase on a per case basis. The following constitutes what subjects can remain private:⚪ Discussions of the client's identity in relation to the commission(s) and its contents.
⚪ Discussions of the commission(s) itself and its contents.
⚪ Live streams or posts of the commission(s) itself and its contents.3. Character design complexity fees start with a minimum of a 10% of the base price and may increase on a per case basis.4. Commission use fees start with a minimum of 50% of the base price for online content and a minimum of 100% of the base price for physical goods. These fees may increase on a per case basis.5. Clients are limited to ten (10) free revisions, both minor and major, during the sketch phase as this is the most crucial part of the commission in order to best portray their wishes. Fees for revision requests beyond the limit will start with a minimum of 5% of the base price and may increase based on the severity of the revision.6. Fees for revision requests made during the lines phase will start with a minimum of 10% of the base price and may increase based on the severity of the revision.7. Fees for revision requests made during the colors phase will start with a minimum of 20% of the base price and may increase based on the severity of the revision.8. After being shown the revised work, clients have up to seven (7) days to approve the revision. Once the seven (7) days pass without approval from the client, the revision will thus be auto-approved and progress will ensue.9. Revision requests are not permitted for previous phases once approved.

ㅤV. CANCELLATION & REFUNDSㅤ1. Clients will receive a full refund if cancellation occurs before production has begun or if I’m unable to complete the commission(s) before the initial due date. Refunds for cancellations during production will occur as follows:⚪ Sketch Phase: 75% refund
⚪ Lines Phase: 50% refund excluding design complexity fees
⚪ Colors Phase: No refunds2. Clients are responsible for communicating the details of their request as dissatisfaction with the final result of the commission is not grounds for a refund.3. Clients filing chargebacks without prior discussion or authorization will be considered a scammer and blacklisted with a notice issued to other artists.

ㅤVI. USE OF COMMISSION(S)ㅤ1. Commissions are not permitted for use in Non-fungible Tokens (NFT), Generative Artificial Intelligence (GenAI), or cryptocurrency and crypto-related affairs. No exceptions.2. Clients are required to utilize the resized version of the commission(s) when posting online.3. Clients are required to properly credit me for the commission(s) by displaying my username or a direct link to my VGen.4. Clients are prohibited from modifying the finalized commission(s) in any way, shape, or form.5. Clients are prohibited from tracing the commission(s) for any reason, including use as a base.

ㅤVII. ARTIST & CLIENT RIGHTSㅤ1. Clients do not gain ownership rights over the commission(s) and are not permitted to claim the commission(s) as their own creation.2. Clients retain the rights to the original character(s) and adopts they own.3. Clients retain the right to use the commission(s) for any and all forms of personal use as long as said use does not provide any profit.4. I retain ownership rights to all commissions both public and private.5. I retain the right to use all public commissions for all forms of promotional purposes.6. Proper credit will be given to the character(s) owned by the client by displaying their VGen username or a direct link to their main social if provided.
